Disclaimer

This disclaimer applies to your use of Atmos Pro and related services provided by Cloud Posse.

1. Service Availability

Unless otherwise provided in the SaaS Agreement or Service Level Agreement, Atmos Pro is provided "as is" and "as available." We do not guarantee that the service will be uninterrupted, secure, or error-free. We reserve the right to modify, suspend, or discontinue the service at any time.

2. No Warranty

Except as expressly set forth in the SaaS Agreement, Terms of Use, or Service Level Agreement, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLOUD POSSE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

3. Infrastructure Deployment

Atmos Pro is a tool that helps manage infrastructure deployment, but we are not responsible for:

  • The actual infrastructure you deploy
  • The configuration of your infrastructure components
  • The security or compliance of your deployments
  • Any issues with third-party tools (Atmos, Terraform, GitHub Actions, etc.)

4. Data and Content

We are not responsible for:

  • The content of your repositories
  • The data you process through Atmos Pro
  • Any sensitive information you choose to share

5. Third-Party Services

Atmos Pro integrates with third-party services (GitHub, cloud providers, etc.). We are not responsible for:

  • The availability or performance of third-party services
  • Changes to third-party APIs or services
  • Data handling by third-party services
  • Compliance with third-party terms of service

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLOUD POSSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE. For paid customers, the aggregate liability cap in Section 9 of the SaaS Agreement controls.

7. Indemnification

Except as modified by the SaaS Agreement for paid customers, you agree to indemnify and hold harmless Cloud Posse from any claims, damages, or expenses arising from your use of Atmos Pro or violation of these terms.

8. Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, or technical failures.

9. Governing Law

This disclaimer is governed by the laws of the State of Delaware, United States.
