Unless otherwise provided in the SaaS Agreement or Service Level Agreement, Atmos Pro is provided "as is" and "as available." We do not guarantee that the service will be uninterrupted, secure, or error-free. We reserve the right to modify, suspend, or discontinue the service at any time.
Except as expressly set forth in the SaaS Agreement, Terms of Use, or Service Level Agreement, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLOUD POSSE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLOUD POSSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE. For paid customers, the aggregate liability cap in Section 9 of the SaaS Agreement controls.
Except as modified by the SaaS Agreement for paid customers, you agree to indemnify and hold harmless Cloud Posse from any claims, damages, or expenses arising from your use of Atmos Pro or violation of these terms.
We are not liable for any failure to perform due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, or technical failures.
This disclaimer is governed by the laws of the State of Delaware, United States.
